These Terms and Conditions set out the rules and conditions for using the Online Store available at www.kids-jungle.pl, including in particular the conditions for placing orders for products available in the Store, the method of delivering ordered products, payment of the purchase price, the Customer’s right to withdraw from the contract, as well as the rules for submitting and handling complaints.
The Online Store is owned by PROXA FURNITURE spółka z ograniczoną odpowiedzialnością (limited liability company) with its registered office in Nowy Sącz (33-300 Nowy Sącz), ul. Osiedlowa 2A, entered in the Register of Entrepreneurs of the National Court Register (KRS) kept by the District Court for Kraków–Śródmieście in Kraków, 12th Commercial Division of the National Court Register under number 0000892154, NIP (tax ID): 7343593894, REGON: 388610752, with share capital of PLN 5,000.00.

For the purposes of these Terms and Conditions, the following terms have the meanings set out below:
Business Day – a working day from Monday to Friday, excluding public holidays.
Customer – a natural person, legal person or organisational unit without legal personality but having legal capacity, using the Online Store, including in particular making purchases.
Consumer – (1) a natural person who concludes a sales contract with the Seller not directly related to their business or professional activity; and (2) a natural person who concludes a sales contract with the Seller directly related to their business activity where, from the content of the contract, it follows that it does not have a professional character for that person, in particular in light of the scope of business disclosed in the Central Register and Information on Economic Activity (a “quasi-entrepreneur”).
Account / Customer Account – the Customer’s individual account created upon registration in the Store, which allows the Customer, among other things, to place Orders and view the history of their Orders.
Cart – a functionality of the Online Store enabling the display of products selected by the Customer for purchase, as well as the entry and modification of Order data, including: quantity of products, delivery address, invoicing details, delivery method, and payment method.
Product – a movable item available in the Store that may be the subject of a Sales Contract concluded between the Customer and the Seller under a distance contract.
Terms and Conditions – these terms and conditions, setting out the rules and conditions for the Seller’s provision of electronic services, including creating and using a Customer Account, and for placing and fulfilling Orders in the Online Store.
Store / Online Store – the online store available at www.kids-jungle.pl.
Website – the website www.kids-jungle.pl.

Contract / Sales Contract – a contract for the sale of Product(s) concluded or entered into between the Customer and the Seller via the Online Store.
Services – services provided free of charge by the Seller by electronic means in connection with operating the Website and the Store.
Order – the Customer’s declaration of intent made electronically via the order form, aimed at concluding a Sales Contract for a Product or Products with the Seller, covering the Product(s) in the Cart at the total price of the Product(s) plus any additional costs, in particular delivery costs.
Through the Online Store, the Seller conducts retail sales and simultaneously provides electronic services to Customers. Via the Store, the Customer may purchase Products listed on the Store’s Website.
The Customer may not make purchases in the Store anonymously or under a pseudonym.
When using the electronic services available through the Store and the Website, it is prohibited to provide content that is unlawful, violates applicable Polish law or good morals (e.g., offensive or vulgar content), as well as data that may pose a risk to the security or stability of the Online Store.
To use the Online Store, the Customer Account and other electronic services described in the Terms and Conditions, you need a personal computer or mobile device (e.g., smartphone or tablet) with an operating system and web browser installed, and Internet access.
The Online Store is adapted to work with all popular operating systems and browsers in line with current market standards. To ensure proper operation of the Online Store and the electronic services described in these Terms and Conditions, and to enhance security, the Seller recommends using software in a current, vendor-supported version. In addition, to ensure full functionality of the Online Store and the Customer Account, essential cookies must be enabled (see details in the privacy policy available in the Online Store).
The Seller will make every effort to ensure the Online Store operates correctly and undertakes to promptly remedy any issues and failures that prevent its proper functioning.

The Seller is entitled to temporarily limit certain Store functions, make them available only at selected times or introduce quantity limits if the absence of limits could affect the continuity and stability of the Store.
Through the Store, the Seller provides the following Services to Customers:
Use of all Services available in the Online Store is voluntary and free of charge. By contrast, Sales Contracts concluded via the Online Store are payable.
Contact form. The contact form available on the Website under “Contact” enables the Customer to send the Seller a message regarding Products and services offered by the Seller in connection with its business activity. The Customer may stop using this Service at any time by simply discontinuing its use.
Newsletter. The newsletter service consists of the Seller periodically sending, to the e-mail address provided by the Customer, e-mails containing information about new Products or services offered by the Seller. Signing up for the newsletter requires an active e-mail address and providing it, together with the first name, in the newsletter sign-up form. Subscription must be confirmed by clicking the confirmation link in the e-mail. The newsletter can be unsubscribed from at any time by clicking the link included in each newsletter message or by sending an e-mail to: hello@kids-jungle.com.
Customer Account. The service enabling creation of a Customer Account is available after completing the registration form and consists of providing the Customer with a dedicated panel on the Website that allows modification of the data provided during registration, as well as tracking the status of Orders and viewing the history of fulfilled Orders. Details on creating a Customer Account are set out in § 5 of the Terms and Conditions.
The Seller may block the Customer Account and other free Services offered on the Website if the Customer acts to the detriment of the Seller or other Customers, violates the law or these Terms and Conditions, or where blocking access to the Account and free Services is justified for security reasons, in particular due to attempts to breach the Store Website’s security or other hacking activities. Blocking access for the above reasons lasts for the time necessary to resolve the issue that gave rise to the block. The Seller will notify the Customer of the block by e-mail sent to the address provided in the registration form.
Order form. The order form is a one-off Service that begins when the first Product is added to the Cart and ends when the Customer places the Order or abandons it. An Order is placed after two consecutive steps are completed: (1) filling in the order form and (2) clicking the “Buy and Pay” button – up to that moment, it is possible to modify the data entered (follow the on-screen messages and information available on the Store Website).
The Customer may create an Account in the Store via the registration form. Creating a Customer Account requires:
Creating a Customer Account is voluntary and free of charge.
The Customer Account is created—and the contract for the provision of this Service by the Seller is concluded—when the Customer clicks the activation link sent to the e-mail address provided in the registration form. The activation link is valid for 24 hours.
The contract for the electronic service of maintaining the Customer Account is concluded for an indefinite period, and the Customer may terminate it with immediate effect at any time by deleting the Account.
Only individual Customer Accounts may be created.
An active Account entitles the Customer in particular to:
a) access and view the list of Orders placed,
b) save and create a list of favourite Products observed by the Customer,
c) manage payment data and delivery addresses,
d) change the password and Account details (including personal data).
The Customer logs in to the Account using their e-mail address and a self-defined password.
During registration and when placing an Order, the Customer is obliged to provide true data. The Seller is not liable for the consequences of providing false data. If any of the above data change while using the Store, the Customer must update their data by contacting Store support or by changing the data saved in the Customer Account.
Creating a Customer Account is not required to place an Order (Orders may be placed as a guest).
The information on the Store’s Website does not constitute an offer by the Seller within the meaning of the Civil Code, but an invitation for Customers to submit offers to conclude a Sales Contract.
The Customer may place Orders in the Online Store via the Website 24 hours a day, 7 days a week.
Orders placed on Saturdays, Sundays, or other public holidays will be processed on the first Business Day immediately following the date the Order was placed.
To place an Order, the Customer must take the following steps:
After clicking the “Buy and Pay” (or equivalent) button, the Customer will be redirected to the payment page to pay for the Order. Once payment is made, the Customer will be redirected back to the Online Store with confirmation that the Order has been placed. At that moment, the Sales Contract for the Products covered by the Order is deemed concluded between the Customer and the Seller. The Customer will receive an order confirmation at their e-mail address.
For Orders that give rise to justified doubts as to their content, the Seller reserves the right to contact the Customer by telephone, using the number provided when placing the Order, to clarify any doubts and confirm the Order.
Please note that some Products presented in the Store may be temporarily or permanently unavailable. Information about a Product’s unavailability is shown on that Product’s page in its description.
Product prices are given in Polish zloty (PLN) and include all components, including VAT. Prices do not include delivery costs. For Customers placing Orders outside Poland (if such an option is available in the Store), the Store enables payment in foreign currencies (e.g., EUR or USD). In such a case, the Product price will be converted into the other currency according to the exchange rate of the National Bank of Poland.
Payment is made in advance exclusively via online payments.
The Customer may pay for the Order, at their choice, by payment card, BLIK, or online payment via an internet payment system operated by an external provider cooperating with the Seller. Detailed information on payment methods is visible in the Online Store. If payment is not recorded within 30 minutes of placing the Order, the Order will be cancelled.
The Store reserves the right to introduce new Products, withdraw Products, run promotions and offer discounts, as well as temporarily offer free Products. This does not affect Orders placed before the effective date of any such changes. Details and duration are always stated in the description of the given Product. Each promotion has a limited duration.
For each Order, an appropriate accounting document is issued electronically and sent to the Customer’s e-mail address, which the Customer agrees to by placing an Order or registering a Customer Account.
The Customer may choose the following delivery options for the ordered Product:
a) personal collection at the Seller’s premises in Nowy Sącz, ul. Osiedlowa 2A, 8:00–16:00 on Business Days — free of charge,
b) delivery of the Order to the Customer via courier or carrier services. Orders will be delivered to the address indicated by the Customer, within the territory of the Republic of Poland and abroad.
A price list showing the costs of the available delivery options will be visible during checkout. The delivery fee depends on the characteristics of the Product (including weight and dimensions) and the delivery address provided.
Delivery costs are borne by the Customer, unless the Seller decides otherwise.
Before accepting a parcel from the courier, the Customer must check whether the packaging of the Product has been damaged in transit. If the parcel shows signs of damage, the Customer should refuse delivery, draw up a damage report in the presence of the courier, and contact the Seller as soon as possible to clarify the matter.
After the Customer places an Order in accordance with the procedure described in § 6 of the Terms and Conditions, an Order confirmation will be sent to the Customer’s e-mail address.
Order fulfilment consists in preparing the Order for shipment to the Customer or for collection at the Seller’s premises. The Order is deemed fulfilled when it has been prepared for shipment or for personal collection by the Customer.
The expected lead time will be indicated by the Seller during checkout. In any case, the Seller will make every effort to fulfil the Customer’s Order as quickly as possible.
Once the Order has been fulfilled, the Seller will send confirmation of fulfilment to the Customer’s e-mail address.
A Consumer (including the quasi-entrepreneur referred to in the Definitions above) who has concluded a Contract with the Seller has the right to withdraw from the Contract without giving any reason within 14 days from the day on which the Consumer or a third party indicated by the Consumer, other than the carrier, takes possession of the Product.
To exercise the right of withdrawal, the Consumer must, within 14 days from the date of delivery of the Product, inform the Seller of their decision to withdraw from the Contract by means of an unequivocal statement—for example, by sending a letter by post to: ul. Osiedlowa 2A, 33-300 Nowy Sącz, or by e-mail to: hello@kids-jungle.com.
If the statement is submitted by e-mail, the Consumer will promptly receive confirmation of its receipt. The Consumer may (but does not have to) use the model withdrawal form attached as Appendix No. 1 to these Terms and Conditions.
To meet the withdrawal deadline, it is sufficient for the Consumer to send the information on exercising the right of withdrawal before the 14-day period expires.
In the event of withdrawal, the Consumer shall promptly return the Product to the Seller, and in any case no later than 14 days from the day on which the Consumer informed the Seller of the withdrawal. The Consumer bears the direct cost of returning the Product. If the withdrawal concerns Products which, by their nature, cannot be returned by ordinary post, the return costs depend on the dimensions and weight of the shipment and on the carrier/courier used (standard courier parcels typically cost from several to several dozen PLN [information as of August 2025; prices may change, e.g. due to inflation]).
The Consumer should keep proof of posting to verify compliance with the return deadline.
The Seller will refund the cost of delivering the Product to the Consumer—up to an amount corresponding to the least expensive delivery option available in the Store.
The refund will be made without undue delay and no later than 14 days from the day on which the Seller was informed of the Consumer’s decision to withdraw from the Contract, subject to the following sentence. If the Seller has not offered to collect the Product from the Consumer, the Seller may withhold the refund until the Product is received back or the Consumer supplies evidence of having sent back the Product, whichever occurs first. The refund will be made using the same means of payment as used by the Consumer in the original transaction, unless the Consumer has expressly agreed to a different method that does not involve any costs for the Consumer.
The Consumer is liable for any diminution in the value of the Product resulting from handling it beyond what is necessary to establish the nature, characteristics, and functioning of the Product.
If the Customer is a Consumer, the Seller is liable for the non-conformity of the Product with the Contract under the rules set out in the Polish Consumer Rights Act of 30 May 2014, in particular Articles 43a et seq.
The Seller is liable for any lack of conformity of the Product with the Contract that existed at the time of delivery and becomes apparent within two years from that time.
Complaints may be submitted in any manner that allows the Seller to read their content, including (at the Consumer’s choice): in person at the Seller’s registered office, by post to: ul. Osiedlowa 2A, 33-300 Nowy Sącz, or by e-mail to: hello@kids-jungle.com.

The Seller suggests that the complaint description include the following information:
Evidence (e.g., photos) related to the complaint may be attached by the Consumer. The Seller may ask the complainant to provide additional information or evidence (e.g., photos) if doing so will facilitate and expedite processing of the complaint. Failure to include the suggested description does not affect the effectiveness of the complaint.
The Seller may replace the Product when the Consumer requests repair, or may repair the Product when the Consumer requests replacement, if the remedy chosen by the Consumer is impossible or would involve excessive costs for the Seller. If both repair and replacement are impossible or would entail excessive costs for the Seller, the Seller may refuse to bring the Product into conformity with the Contract.
When assessing whether costs are excessive for the Seller, all circumstances are taken into account, in particular the significance of the lack of conformity, the value of the Product that would be in conformity, and the inconvenience to the Consumer resulting from changing the remedy.
The Seller will carry out the repair or replacement within a reasonable time from being informed by the Consumer of the lack of conformity and without undue inconvenience to the Consumer, taking into account the nature of the Product and the purpose for which the Consumer purchased it. The Seller bears the costs of repair or replacement.
The Consumer shall make the Product available to the Seller for repair or replacement. The Seller will collect, or arrange collection of, the Product from the Consumer at the Seller’s expense. Transport details will be agreed by the Parties once the complaint has been accepted by the Seller.
If the Product was installed before the lack of conformity was discovered, the Seller will uninstall the Product and reinstall it after repair or replacement, or arrange for these actions to be performed at the Seller’s expense.
If the Product is not in conformity with the Contract, the Consumer may submit a statement requesting a price reduction or withdrawal from the Contract if:
The reduced price must be in proportion to the price under the Contract, reflecting the ratio of the value of the non-conforming Product to the value of a conforming Product.
The Seller will promptly refund amounts due to the Consumer as a result of a price reduction, no later than 14 days from receiving the Consumer’s statement on the price reduction.
The Consumer may not withdraw from the Contract if the lack of conformity is insignificant. It is presumed that any lack of conformity is significant.
In the event of an effective withdrawal from the Contract, the Consumer shall promptly return the Product to the Seller’s registered office at the Seller’s expense or enable the Seller to collect it. The Seller will refund the price to the Consumer without undue delay, no later than 14 days from receiving the Product or proof of its return.
In the event of withdrawal or a complaint, the Consumer undertakes to properly pack and secure the Product until it is collected/returned to the Seller.
The Seller will refund the price using the same means of payment as used by the Consumer, unless the Consumer has expressly agreed to a different method that does not involve any costs for the Consumer.
The Seller will respond to the Consumer’s complaint within 14 days from the date of receipt. The Seller’s response will be sent to the Consumer by e-mail or via SMS to the Consumer’s phone number. If the Seller does not respond within 14 days, the complaint is deemed to have been accepted.
If a Product is covered by a warranty, information on the content and terms of the warranty and the identity of the guarantor (i.e., the person or entity liable under the warranty) will be provided on that Product’s page in the Online Store. Where applicable, the warranty document will also be enclosed with the warranted Product. Granting a warranty is not obligatory. Even if a Product is not covered by a warranty, the Seller remains liable to the Consumer for non-conformity/defects under the Contract.
This § 12 applies only to Customers who are not Consumers.
Subject to the further provisions of this paragraph and pursuant to Article 558 § 1 of the Polish Civil Code, the Seller’s liability under statutory warranty (rękojmia) for the Product towards a Customer who is not a Consumer is excluded.
A non-Consumer Customer may submit a complaint, it being understood that the Seller’s liability is limited solely to the obligation to remove the defect.
If a complaint is accepted, the Seller will, at its discretion, promptly remove the defect, replace the Product with a new one, or withdraw from the Contract by refunding the price paid for the Product. Delivery costs are not refundable.
In any case, the Seller’s liability for damages to a Customer who is not a Consumer is limited to the amount paid by that Customer to the Seller for the purchase of the Product concerned.
Upon the Seller handing the Product over to the carrier, the benefits and burdens related to the Product and the risk of accidental loss of or damage to the Product pass to the Customer who is not a Consumer. In such a case, the Seller is not liable for loss, shortage, or damage to the Product occurring from the time it is accepted for carriage until it is delivered to the non-Consumer Customer, nor for delays in transport.
The Seller agrees to submit any disputes arising in connection with Contracts concluded with Consumers to mediation. The details will be determined by the parties to the dispute.
The Consumer may use out-of-court methods of handling complaints and pursuing claims. Detailed information on out-of-court complaint handling and pursuing claims is available at: http://www.polubowne.uokik.gov.pl.

The colours of Products may be displayed differently on different types of monitors.
The Store reserves the right to amend the Terms and Conditions for important reasons. An important reason for amending the Terms and Conditions is any of the following:
Any amendment to the Terms and Conditions applies only prospectively (it does not affect Orders placed before the amended Terms and Conditions start to apply to the Customer).
The Seller will inform the Customer of any amendment to the Terms and Conditions at least 14 days in advance by sending an email to the address assigned to the Customer Account. The email will include the amended Terms and Conditions or a link to the Terms and Conditions provided on a durable medium (i.e., in a way that allows them to be stored and downloaded with a guarantee of their integrity). Information on the amendment will also be published in the Online Store.
The 14-day period referred to above may be exceptionally shortened only when necessary to ensure compliance of the Terms and Conditions with the law or to adapt them to a ruling, decision, or similar act issued by a competent authority, or to counter an unforeseen and immediate threat related to protecting the Online Store or its users against fraud, malware, spam, data breaches, or other cybersecurity risks. The period may also be shortened if the amendment consists solely of updating addresses, domains, or registration data, or of correcting an obvious error—provided this does not affect the Customer’s rights.
If the Customer does not accept the amendments to the Terms and Conditions, the Customer may terminate the Customer Account Service (i.e., terminate the agreement for the provision of the Customer Account Service). If the Customer does not resign, the amended Terms and Conditions will bind the Customer (unless the Customer resigns from the Customer Account before the effective date of the amendments).
The Seller may enable the Customer to accept the amended Terms and Conditions earlier. In such a case, the amended Terms and Conditions apply to the Customer from the moment of acceptance.
The law governing all disputes arising under the Terms and Conditions is Polish law. If the Customer is a Consumer with habitual residence in another EU Member State, the Consumer additionally enjoys protection afforded by the mandatory provisions of the law of that state.
Nothing in these Terms and Conditions excludes or limits any Consumer rights regarding Product defects that arise from mandatory provisions of law. In the event of any conflict between these Terms and Conditions and mandatory provisions of law, those provisions shall prevail.

These Terms and Conditions enter into force on 01/07/2025.
